1. Agreement to these Terms
These Terms of Service (“Terms”) govern your access to and use of the EstateFlow website, web application, and mobile applications (the “Service”), operated by Mohamad El Ghali (“EstateFlow”, “we”, “us”, or “our”).
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you use the Service for a company, you represent that you have authority to bind that company. If you do not agree, do not use the Service.
2. The Service
EstateFlow helps real-estate developers and agencies manage projects, units, clients, contracts, payment plans, payments, and related documents, and gives their buyers a portal to view their purchase.
We may add, change, or remove features, and we may suspend or discontinue parts of the Service. We do not guarantee that any feature will always be available.
3. Accounts and eligibility
You must be at least 18 years old and able to enter into a binding agreement to use the Service. You must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account. Tell us promptly if you suspect unauthorised access.
4. Company workspaces and roles
Companies may invite team members to their workspace and assign roles that control what those members can see and do. A Company is responsible for its workspace, its users, and the data it uploads or manages. If you are a member of a Company workspace, your administrator can manage or remove your access.
5. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- Use the Service to break any law or infringe anyone's rights.
- Upload malware, attempt to gain unauthorised access, probe, scan, or disrupt the Service.
- Scrape, resell, or copy the Service or its content except as allowed by these Terms.
- Upload data you do not have the right to share, including third-party personal data collected without a lawful basis.
- Use the Service to send spam or unlawful communications.
6. Client portal and buyer data
If you are a buyer, you may access a portal to view your contract, payment schedule, receipts, and related documents. Portal access is provided by the Company you purchased from. If your purchase details are inaccurate, contact that Company.
If you are a Company, you are responsible for the accuracy of the buyer data you upload and for having a lawful basis to process it, including any notices you must give to your buyers.
7. Contracts, payments, and no professional advice
EstateFlow is a record-keeping and workflow tool. We are not a party to any sale, purchase, or payment between a Company and a buyer, and we do not hold, transfer, or guarantee funds. Documents generated by the Service, including contracts, payment plans, and receipts, are based on the data entered by users.
The Service does not provide legal, tax, financial, or accounting advice. You are responsible for reviewing documents and obtaining professional advice where needed.
8. Intellectual property
The Service, including its software, design, and content provided by us, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You keep ownership of the data and content you upload; you grant us the rights needed to host and process it to provide the Service.
9. Third-party services
The Service relies on third-party providers, including Supabase and Google Firebase. Their services may be subject to their own terms and availability. We are not responsible for third-party services we do not control.
10. Availability and disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost. You are responsible for keeping your own copies of important documents.
11. Limitation of liability
To the maximum extent permitted by law, EstateFlow and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us, if any, for the Service in the twelve months before the claim.
12. Indemnification
You agree to indemnify and hold harmless EstateFlow and its operator from claims, damages, liabilities, and expenses arising from your use of the Service, your content or data, or your breach of these Terms or applicable law.
13. Termination
You may stop using the Service at any time and may request deletion of your account. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Provisions that by their nature should survive termination will survive.
14. Governing law and disputes
These Terms are governed by the laws applicable at the operator's principal place of business, without regard to conflict-of-law rules. The courts of that jurisdiction will have exclusive jurisdiction over disputes, unless mandatory consumer-protection law provides otherwise.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the date at the top of this page and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
